On September 14, 2026, I filed a Motion to Intervene Pursuant to Fed. R. Civ. P. 24 and Motion to Compel a True Final Distribution and Receivership Wind-Down with the U.S. District Court for the Northern District of Texas, Dallas Division.

The Court registered the motion on September 15, 2026, as Document 3644 in Case No. 3:09-CV-0298-N.

Purpose of the Motion

  • Motion to Intervene: I ask the Court to formally recognize me as a party-in-interest in this case, in my individual capacity as a direct claimant, based on my Power of Attorney filed as Document 3624.
  • Motion to Compel a True Final Distribution: I ask the Court to order the Receiver to distribute all remaining available funds—including the $8.1 million in Swiss funds—and to submit a formal Wind-Down Plan to close the Receivership.

Requested Relief

  1. Grant the Motion to Intervene under Fed. R. Civ. P. 24;
  2. Direct the Receiver to file an updated, itemized financial statement within 21 days;
  3. Direct the Receiver to close the 12th Distribution accounting within 60 days;
  4. Direct the Receiver to pool all unencumbered cash—including the $8.1 million in Swiss funds and all accumulated reverted funds—into a single, true Final Distribution;
  5. Direct that Swiss funds be distributed exclusively to creditor-victims pursuant to the 2013 Cross-Border Protocol;
  6. Direct the Receiver to submit a formal Receivership Wind-Down Plan within 30 days and close the estate within 60 days following completion of the Final Distribution; and
  7. Grant such other relief as the Court deems just and proper.

El 14 de septiembre de 2026, presenté una Moción para Intervenir conforme a la Regla 24 de las Reglas Federales de Procedimiento Civil y Moción para Exigir una Verdadera Distribución Final y el Cierre de la Sindicatura ante el Tribunal Federal del Distrito Norte de Texas, División Dallas.

El Tribunal registró la moción el 15 de septiembre de 2026, como Documento 3644 en el Caso No. 3:09-CV-0298-N.

Propósito de la Moción

  • Moción para Intervenir: Solicito al Tribunal que me reconozca formalmente como parte en interés en este caso, en mi capacidad individual como reclamante directo, respaldado por mi Poder Notarial presentado como Documento 3624.
  • Moción para Exigir una Verdadera Distribución Final: Solicito al Tribunal que ordene al Síndico distribuir todos los fondos disponibles remanentes—incluyendo los $8.1 millones en fondos suizos—y presentar un Plan Formal de Cierre para cerrar la Sindicatura.

Alivio Solicitado

  1. Conceder la Moción para Intervenir bajo Fed. R. Civ. P. 24;
  2. Dirigir al Síndico a presentar un estado financiero actualizado y detallado dentro de 21 días;
  3. Dirigir al Síndico a cerrar la contabilidad de la 12ª Distribución dentro de 60 días;
  4. Dirigir al Síndico a agrupar todo el efectivo no gravado—incluyendo los $8.1 millones en fondos suizos y todos los fondos revertidos acumulados—en una sola Distribución Final verdadera;
  5. Dirigir que los fondos suizos sean distribuidos exclusivamente a las víctimas-acreedoras conforme al Protocolo Transfronterizo de 2013;
  6. Dirigir al Síndico a presentar un Plan Formal de Cierre de la Sindicatura dentro de 30 días y cerrar el patrimonio dentro de 60 días siguientes a la finalización de la Distribución Final; y
  7. Conceder cualquier otro alivio que el Tribunal considere justo y apropiado.
