COViSAL #208 – Message from Gilardi & Co. regarding uncashed or void
checks
Dear Friend,
Some of you have notified me
about receiving an email from info@e.stanfordfinancialclaims.com with the subject: "Request for Information re Uncashed & Void
Stanford Receivership Distribution Check(s)." This message has raised
concerns about the sender's authenticity.
In light of this situation, I
contacted the Receiver Ralph Janvey and his lawyers to clarify the
matter. Below, I share their response translated into Spanish, along with the
message that COViSAL sent to the Receiver.
Response from the Receiver’s
lawyer, Ralph Janvey ( March 19, 2025):
Subject: Urgent – Suspicious email to Stanford victims from the
Receiver’s Claims Agent in the U.S.
“The email that is
the subject of your inquiry was sent from the claims agent for the Stanford
Financial Receiver and contains a time-sensitive request for a response from
those Stanford CD claimants to whom it was sent.”
“COViSAL’s email to Ralph
Janvey, OSIC lawyers, and Gilardi & Co.:
Date: March 19, 2025
Subject: Urgent – Suspicious email to
Stanford victims from the U.S. Receiver’s Claims Agent
Dear Mr. Janvey, lawyers, and Gilardi & Co. (Verita Global):
Many Stanford claimants have
reported receiving an email from the address info@e.stanfordfinancialclaims.com, which claims to be from the U.S. Receiver’s Claims Agent. However, this
address differs from the standard one used by your office (info@stanfordfinancialclaims.com), raising doubts about its legitimacy.
We request confirmation as to
whether this email is valid, secure, and officially associated with the U.S.
Receiver’s Claims Agent, Gilardi & Co. (Verita Global).
Below, I attach the message
that many claimants have received:
Message received by claimants
(March 17, 2025):
“Subject: Request for Information re Uncashed & Void Stanford
Receivership Distribution Check(s)
Dear Claimant(s):
The Receivership’s records
reflect that the Receivership has sent to you one or more distribution checks
under the U.S. District Court’s interim distribution plans that have reverted
to the Receivership Estate because the check or checks were not cashed within
180 days after their issuance. In particular, the District Court’s orders
approving the distribution plans state: “Each check shall state on its face
that it will be void if not cashed within 180 days from the date of issue. The
Investor CD Claimant(s) to whom the check was originally issued may submit a
written request for reissuance to the Receiver within 180 days of the original
date of issuance of the check. All funds represented by void checks not timely
reissued shall revert to the Receivership Estate.” See http://www.stanfordfinancialreceivership.com
for copies of the Court’s orders.
As a result, within 30 days
of this message, you must send the Receivership your wire instructions (using
the form found here) or an updated and correct physical payment mailing
address so that we can reissue those payments to you. You must include copies
of your current government-issued ID(s) as well. If you do not respond with the
necessary information within 30 days, funds from the prior reverted check(s)
will remain reverted to the Receivership Estate and will not be reissued to
you, and the Receivership will consider your claims as ineligible to receive
payments under any future distribution plans due to your failure to provide
that information.
Sincerely,
Gilardi & Co. LLC, as
Claims Agent for Receiver Ralph S. Janvey."
Given the potential for fraud,
we urge that this matter be addressed immediately and that clarifications be
provided to all affected claimants. We appreciate your prompt attention to this
urgent issue.
Sincerely,
Jaime R. Escalona
On behalf of COViSAL, for restitution since 2009.”
Recommendations:
If you received this message, it indicates that you have an issue with uncashed
or void checks. You must respond to Gilardi & Co. using their
official email: info@stanfordfinancialclaims.com.
For the Receivership to
reissue uncashed or void payments, the claimant must choose one of the
following two options:
First option: Provide the Receivership with an updated and correct physical mailing
address so that the Receivership can reissue the checks.
Second option: Submit a written request for a bank transfer for the amount of the uncashed
check.
Gilardi & Co. requires
sending the duly signed Wire Transfer Form, attaching the claimant’s
current government-issued identification and a "Bank Statement"
proving that the claimants are the same holders of the destination bank
account.
Best regards,
Jaime
