El 5to. Circuito Reversa las Decisiones de SLUSA  del Juez Godbey El 19 de marzo, 2012, el 5to Circuito de la Corte de Apelaciones emitió su opinión revocando las órdenes del Juez Godbey encontrando que SLUSA, la Securities Litigation Uniform Standards Act, aplicadas a y que requerían la desestimación de las demandas Roland v. Green, Troice v. Willis y Troice v. Proskauer Rose.  El 5to Circuito remitió las demandas de Roland v. Green a la corte Estatal de Louisiana, donde fue originalmente registrada, y remitió las demandas de Troice v. Willis y Troice v. Proskauer Rose a la Corte del Juez Godbey para su procedimiento judicial adicional.     --- traducción al español por COViSAL --                              Ultima Actualización – 19 de marzo, 2012     Desde la conclusión del juicio criminal de Allen Stanford en Houston, Texas,  el Examinador ha recibido un gran número de correos electrónicos de inversionistas de Stanford solicitando la liberación inmediata de aproximadamente $330 millones que han estado congelados en Canadá, Inglaterra y Suiza, a petición del Departamento de Justicia (“DOJ”). De estos correos electrónicos se aprecia que existe una gran confusión entre los inversionistas de Stanford sobre la situación de los fondos congelados. Actualmente, los fondos han sido congelados en Canadá, Inglaterra y Suiza, a petición del DOJ. Las cantidades aproximadas congeladas en cada jurisdicción son, en dólares americanos, de $200 a $210 millones en Suiza,  $100 millones en Inglaterra y $20 millones en Canadá....

5th CIRCUIT REVERSES JUDGE GODBEY'S SLUSA DECISIONS On March 19, 2012, the 5th Circuit Court of Appeals issued its opinion reversing Judge Godbey’s orders finding that SLUSA, the Securities Litigation Uniform Standards Act, applied to and required the dismissal of the Roland v. Green, Troice v. Willis and Troice v. Proskauer Rose lawsuits. The 5th Circuit remanded the Roland v. Green lawsuit to the Louisiana state court where it was originally filed, and it remanded the Troice v. Willis and Troice v. Proskauer Rose lawsuits to Judge Godbey’s court for further proceedings. The Defendants in any or all of those lawsuits may seek further review by the full 5th Circuit court or may file a petition for review with the United States Supreme Court. Last Update March 19, 2012 EXAMINER'S COMMENT CONCERNING FROZEN STANFORD FUNDS   Since the conclusion of Allen Stanford’s criminal trial in Houston, Texas, the Examiner has received a large number of emails from Stanford Investors seeking the immediate release of the approximately $330 million that has been frozen in Canada, the United Kingdom and Switzerland at the request of the Department of Justice (DOJ). From those emails, it is apparent that there is considerable confusion among Stanford Investors concerning the status of those frozen funds. At present, funds have been frozen in Canada, the United Kingdom and Switzerland at the request of the DOJ. The approximate amounts frozen in each jurisdiction are US $200 to $210 million in Switzerland, US $100 million in the United Kingdom, and US $20 million in Canada.
