Carta Abierta A la Honorable Judge Esther en el Caso № 2:24-cr-00667-ES-1. United States v. TD Bank, N.A.

A la Honorable Judge Esther Salas y a todos los abogados involucrados en el Caso № 2:24-cr-00667-ES-1. United States v. TD Bank, N.A.

Nosotros, víctimas del esquema Ponzi de Allen Stanford, representadas por Jaime R. Escalona, líder de la Stanford Víctims Coalition Latin America (COViSAL), coalición que reune desde el 2009 a miles de familias en América Latina, Estados Unidos y en el mundo entero; que perdimos los ahorros de toda nuestra vida en el esquema Ponzi de Allen Stanford, instamos al Tribunal para que antes que emita su fallo, considere los siguientes puntos:

·         Daño irreparable: Las víctimas de Stanford han sufrido pérdidas económicas devastadoras y muchas se encuentran en una situación financiera precaria, sin recursos suficientes para cubrir sus gastos básicos como tratamientos médicos y manutención.

·         Responsabilidad del TD Bank: El papel del TD Bank en el esquema Ponzi fue fundamental. Al facilitar el lavado de dinero, el Banco contribuyó directamente al daño causado a miles de inversionistas.

·         Un hecho inexplicable e inaceptable. El Departamento de Justicia ("DOJ") había recibido amplia Información del U.S. Receiver y de su abogado sobre la participación del TD Bank y en ningún momento el DOJ le informó a la Official Stanford Investors Committee ("OSIC") ni al U.S. Receiver que estaban investigando al TD Bank por lavado de dinero.

·         Falla del Departamento de Justicia: La inacción del DOJ al no investigar a tiempo la participación del TD Bank permitió que el fraude continuara durante años, agravando el sufrimiento de las víctimas.

Llamado a la justicia. COViSAL exige al DOJ que asuma su responsabilidad y trabaje en conjunto con la Judge Esther Salas para que los $3 mil millones que recibirá del TD Bank, N.A. (TDBNA) y de su empresa matriz TD Bank US Holding Company (TDBUSH) por multas, los asigne a las devastadas víctimas de Stanford.

Imploramos al Tribunal que reconozca la gravedad de este asunto y garantice que se haga justicia. Las víctimas del fraude de Stanford merecen ser indemnizadas por este crimen atroz.
